The Madras High Court issued a stern warning to magistrates who take drunken driving cases lightly. Justice M M Sundresh said that the circumstance should be taken into consideration and punishment should be given. The judge also made it clear that provisions of Motor Vehicles Act, criminal jurisprudence should be taken into consideration before deciding on the punishment.

The Madras High Court also made it clear that the police can book drunken drives who have caused fatal accidents under IPC Section 304 (ii) under which the driver is entitled to 10 years imprisonment.
